The Madras High Court has expressed shock over the misuse of the provisions of the Protection of Child from Sexual Offences Act, by a mother just for getting custody of her 11 year old daughter. The woman had made false allegations against her husband saying that he was sexually abusing his own daughter.
While quashing an FIR registered under the Posco Act, Justice N. Anand Venkatesh said that the mother should not be let off and should be made to suffer the consequences for having made false allegations against her husband at the cost of her own daughter. The Police have been directed to proceed against the mother in accordance with law for the false complaint given by her. The Judge went on to say that this should serve as a lesson for all those who try to misuse the provisions of the Posco Act for their own selfish ends.
