The Supreme Court reduced a 12 year sentence by 5 years awarded to a man who was convicted for murder over a stolen pigeon.
A bench comprising of Justices R.Subhash Reddy and Hrishikesh Roy allowed an appeal of the person who challenged his conviction for murder under the Indian Penal Code and reduced his term from 12 years to 7 years. The court found from the evidence and the material that was placed on record that there was no intention to kill the victim. It was clear that the fight took place on the spur of the moment and that the appellant had no intention to cause death or cause any body injury likely to cause death. It concluded that the High Court ought not to have convicted the appellant for the offence under Section 304 of IPC.
The accused Kala Singh hit the victim who stole the pigeon on his head resulting in his death. As there was no intention to cause death, the SC altered the sentence and directed the appellant to undergo rigorous imprisonment for 7 years and pay a fine of Rs 10,000.
