Supreme Court cancels its May 2022 order in the Bilkis Bano case

The Supreme Court cancelled an order passed in May 2022 in the Bilkis Bano case passed by Justice Ajay Rastogi , a former judge of the Supreme Court. This order allowed the 11 men who raped Bilkis Bano and murdered her family during the 2002 Godhra riots to appeal to the Gujarat government for early remission.

According to the court, this order was obtained by fraudulent means by suppressing facts. The 11 convicts have been given two weeks time to return to jail.
The convicts were released by the Gujarat government on Independence Day in 2022 on the basis of an obsolete law. The government ordered the release after it consulted a panel that declared the rapists and murderers to be ”sanskari brahmins”. They were released based on a 1992 remission policy that has been superseded by a law barring releases in capital offence cases.
