Shahrukh Khan’s son Aryan Khan was arrested last year and spent 20 days in jail. He has now been given a clean chit in the drugs-on-cruise case.
Aryan was arrested by the Narcotics Control Bureau from a cruise ship off the Mumbai coast in October 2021 on allegations of drug consumption. The NCB has now concluded that there is no evidence against Aryan and therefore his name was not there in the chargesheet filed into court. As he has been cleared of all the charges, the question arises as to whether the state will be liable for wrongful prosecution.
As per the Indian Constitution, there are provisions for victims of wrongful imprisonment to approach court for compensation under Articles 21 and 22. While Article 21 deals with protection of right to life and liberty, Article 22 deals with protection against arbitrary arrests, illegal detention etc.
