The Supreme Court has taken on file a batch of petitions challenging the criminalization of the pronunciation of Triple Talaq. Notice has been issued to the Centre. A Bench comprising of Justices N V Ramana and Ajay Rastogi issued notice to the Central Government.
One petition was by the Jamiat Ulama- I- Hind, and the other by the Samastha Kerala Jamiathul. Both petitions claimed that the imprisonment of three years prescribed by the Act was disproportionate and excessive. They also felt that the main objective of the law was to punish Muslim husbands and that protection of wives cannot be achieved by incarceration of the husbands.
