No need for hubby to consent for abortion

The Supreme Court refused to interfere with a judgment of the Punjab and Haryana High Court which held that the husband cannot force his wife to continue an unwanted pregnancy. A three judge bench while concurring with the High Courts judgment dismissed the appeal filed by the husband challenging the judgment.

They held that as per law,only a woman’s consent is necessary for the medical termination of the pregnancy and that she is entitled to say that she did not want to bear the child of her husband. It also held that no question of damages would arise.
