Advocate Sudha Ramalingam has filed a Public Interest Litigation in the Madras High Court highlighting the various short comings in the implementation of the Protection of Women from Domestic Violence Act, 2005.
The First Bench comprising of Chief Justice Vijaya Kamlesh Tahilramani and Justice M.Duraiswamy heard the PIL and ordered the State Government to file a reply in two months. The Petitioner said that most Magistrates refused to grant interim relief like protection orders, monetory orders or custody orders to the applicants. Moreover the presence of the applicants for every hearing is insisted upon and this is totally unnecessary. She also brought to the notice of the Court the high rate of domestic violence in the State.
