The Supreme Court transferred the trial of the Kathua case to Pathankot district. A Special Bench of Chief Justice Dipak Misra,and Justices D.Y.Chandrachud and Indu Malhotra shifted the trial as a fair trial would not be possible in Kathua. The court held that fair trial and fear were contradictory concepts and could not coexist and a fair trial meant that victims, accused persons and witnesses did not have any fear or phobia to attend court.
The court also directed the trial proceedings to be held in camera to protect the witnesses. The Pathankot district judge was directed to conduct the trial. Chief Minister Mehbooba Mufti hailed the decision of the Supreme Court to transfer the case to Pathankot.
