A 11 year old girl who was raped by her relative was permitted by the Madurai Bench of the Madras High Court to terminate the 24 week old foetus. A petition the first of it’s kind was filed by the mother of the victim for permission to terminate the pregnancy as the doctor had opined that the continuation of the pregnancy was risky.
The Court ordered the Dean of the Government Rajaji Hospital in Madurai to constitute a medical board to examine the victim. The Medical Board gave it’s opinion that continuation of the pregnancy would be more risky than second trimester termination.
